Terms of Service
1. General Provisions
1.1. These Terms of Service govern the provision and use of transport, logistics, and related services offered by EA Logistic, a company registered under the laws of the Republic of Poland.
1.2. By using our services, you agree to be bound by these Terms, our Privacy Policy, and other regulatory documents.
1.3. EA Logistic reserves the right to update or amend these Terms at any time. The most current version will always be available on our website.
2. Service Provision
2.1. EA Logistic provides freight transportation, warehousing, customs clearance, logistics consulting, and other related services.
2.2. All services are provided in accordance with applicable Polish and EU legislation, including Regulation (EC) No. 1071/2009 and the CMR Convention.
2.3. We strive to ensure the highest levels of accuracy, reliability, and timely delivery of goods.
3. Customer Responsibilities
3.1. The customer is responsible for providing complete and accurate information about the cargo, including type, volume, weight, storage conditions, and delivery deadlines.
3.2. The customer is liable for ensuring that the goods comply with all customs and legal requirements in both the country of origin and destination.
3.3. In the case of misinformation or breach of transportation rules by the customer, EA Logistic reserves the right to refuse service without compensation.
4. Limitation of Liability
4.1. EA Logistic shall not be held liable for delays caused by force majeure events such as natural disasters, strikes, accidents, customs delays, and other unforeseen circumstances.
4.2. The company is not responsible for any loss or damage resulting from improper packaging, inaccurate information, or violation of transport regulations by the customer.
4.3. Compensation is available only within the limits set by the CMR Convention and applicable Polish law.
5. Payment Terms
5.1. Payments for services are made based on the issued invoice after order confirmation.
5.2. The standard payment term is 14 calendar days from the invoice date unless otherwise agreed in writing.
5.3. In the event of delayed payment, the customer shall pay a penalty in accordance with Polish legislation.
6. Confidentiality and Data Protection
6.1. All information exchanged between the parties is considered confidential.
6.2. EA Logistic adheres to the General Data Protection Regulation (GDPR) in the processing of personal data.
6.3. Customers have the right to request access to, correction, or deletion of their personal data.
7. Dispute Resolution
7.1. All disputes arising between the parties shall be resolved through negotiation.
7.2. If an agreement cannot be reached, the dispute will be submitted to the competent court in Poland where EA Logistic is registered.
